§ 58-244. Commercial paper; intent to defraud.

  • (a)

    It shall be unlawful for any person within the town limits, to draw, make, utter, issue or deliver to another a check, draft or other written order on any bank or depository for payment of money or its equivalent:

    (1)

    With the intent to defraud to obtain money, services, credit or property of any kind or nature, or anything of value; and

    (2)

    By any person who does not have an account with the bank on which the check is drawn, or has insufficient funds in the bank to cover the check.

    (b)

    Stopping payment with intent to defraud is also unlawful. A fraudulent check written for a preexisting debt is not a violation of this section.

    (c)

    Any person, which includes corporations, partnerships and other entities, found to be in violation of this section, shall face a fine as provided in section 1-12 and individuals may in lieu of said fine face imprisonment as provided in section 1-12.
