§ 74-1. Violations and penalties.

The owner or agent of the owner of any land located within the platting jurisdiction of the town planning commission as described herein who transfers or sells such land by reference to or exhibition of or by other use of a plat of subdivision of such land before such plat has been approved by the planning commission and recorded in the office of the clerk of court in and for the county, shall be guilty of a misdemeanor for each lot so transferred or sold, and upon conviction thereof, shall be punished by a fine of $200.00 or imprisonment for 30 days. The description by metes and bounds in the instrument of transfer or other documents used in the process of selling or transferring shall not exempt the transaction from such penalties. The town may enjoin such transfer or sale or agreement by appropriate action.
