§ 74-143. Generally.

  • (a)

    To be paid in advance by subdivider. A well-designed subdivision means little to a prospective lot buyer until he can see actual physical transformation of raw land into lots with all necessary improvements provided. Likewise, a well-designed subdivision is not an asset to the community until the necessary improvements have been installed. In order that prospective lot purchasers may get usable products and new subdivisions may be an asset rather than a liability to the community, the subdivider shall pay for the improvements required by these regulations necessary to serve his subdivision prior to the approval of the final plat.

    (b)

    Natural gas. When gas lines are located in a street right-of-way, where possible, such lines shall be located outside the portion of the street to be surfaced to prevent having to cut into the paved surface to serve abutting properties.

    (c)

    Water supply. When a water system is installed in a subdivision, water mains, valves and fire hydrants shall be installed according to plans and specifications approved by the department of health and environmental control. When the water main is located in the street surface to serve the abutting lots, a connection shall be stubbed out to the property line to serve each lot before the street is surfaced. The town will supply water to the entrance of the subdivision.

    (d)

    Sanitary sewerage.

    (1)

    When a sanitary sewer is installed in a subdivision, the sewer shall be installed to the plans and specifications approved by the department of health and environmental control. When the sewer line is located in a street right-of-way and it will be necessary to cut into the street surface to serve the abutting lots, a connection shall be stubbed out to the property line to serve each lot prior to surfacing the street. The town will supply sanitary sewage to the entrance of the subdivision.

    (2)

    A sewer system approved by the department of health and environmental control is a mandatory requirement for all subdivisions. In order to promote health and safety, the town encourages a developer to use a sanitary sewer system rather than a private system utilizing septic tanks. The town will install a sanitary sewerage connection to an entry point at or near each subdivision where feasible, taking into consideration the cost involved and such other relevant factors as the town deems appropriate. Any cost of a sewer system which is past the entrance to the subdivision will be paid by the developer at his expense. The town retains the option to allow and require the developer to use septic tanks or an alternate sewer system if:

    a.

    Running of sewer lines to the subdivision is not financially feasible to the town;

    b.

    The department of health and environmental control will approve an alternate sewer system.

    (e)

    Paved curbs. Paved concrete curbs shall be installed to ensure accordance with plans and specifications approved by the town engineer.

    (f)

    Street grading and surfacing. Street grading, base preparation and surfacing shall be carried out by the subdivider according to plans and specifications approved by the town engineer.

    (g)

    Storm drainage. An adequate drainage system, including necessary open ditches, pipes, culverts, storm sewers, intersectional drains, drop inlets, bridges, and other necessary appurtenances shall be installed by the subdivider according to plans and specifications approved by the town engineer.

    (h)

    Street name signs. Street name signs shall be installed at all intersections within a subdivision. The town will assume the costs of ordinarily designed street signs. Additional costs will be paid by the developer. The location and design shall be approved by the town engineer. Street signs will only be provided within the town limits.

    (i)

    Street lights. Any street lights installed will meet town specifications and be designed by Duke Power Company for the purpose of decoration and illumination. Street lights will only be provided within town limits.

    (j)

    Addresses. All addresses will be clearly marked.
