§ 70-68. Offenses at parks.

  • (a)

    It will be unlawful for any person to willfully and maliciously damage, or otherwise injure or destroy any personal property of the town located in the Mineral Spring Park, Brookdale Park, Veterans Park, Gray Drive Trail, town walking trails, and any other parks, trails, or recreational areas operated by the town.

    (b)

    It will be unlawful for any person to willfully and maliciously damage, or otherwise injure or destroy any real property of the town located in the Mineral Spring Park, Brookdale Park, Veterans Park, Gray Drive Trail, town walking trails, and any other parks, trails, or recreational areas operated by the town.

    (c)

    It will be unlawful for any person to be present in or otherwise occupy or trespass within the Mineral Spring Park, Brookdale Park, Veterans Park, Gray Drive Trail, town walking trails, and any other parks, trails, or recreational areas operated by the town at any time whatsoever other than when the parks are open to the general public. This section does not include maintenance work done by town employees, or independent contractors and volunteers acting under the express written permission of the mayor and town council. The operating hours of each park shall be posted in a conspicuous manner at all times.

    (d)

    It will be unlawful for any person to park a motor driven vehicle within the Mineral Spring Park, Brookdale Park, Veterans Park, Gray Drive Park, town walking trails, and any other parks, trails, or recreational areas operated by the town during such time as the parks are not opened for occupancy by members of the general public. This section does not apply to motor vehicles or the like which may be on exhibit or otherwise present in connection with and participating in a duly scheduled festival or public event taking place at the parks.

    (e)

    It is unlawful for any person to harm or otherwise vandalize any real or personal property located in the Mineral Spring Park, Brookdale Park, Veterans Park, Gray Drive Park, town walking trails, and any other parks, trails, or recreational areas operated by the town.

    (f)

    The penalty for violation of any of the prohibitions of this section shall be the maximum penalty set by the legislature of the state for offenses triable in the magistrate's court or municipal court and to the extent that these maximum penalties may be raised by the legislature, these increases are incorporated by reference herein as fully as if reenacted by the mayor and town council. The trial court may also order restitution pursuant to S.C. Code 1976, § 17-25-322, and the town may also file a civil action in the appropriate court of common pleas to collect restitution. Should a portion of S.C. Code 1976, § 17-25-322, be deemed unconstitutional or inapplicable, the town may rely on any remaining provisions of that section or any successor sections to seek restitution.
